Jury Set In Tensing Retrial, Visits Scene

Efforts to seat a jury in Cincinnati are set to resume, with both sides now supporting a change of venue in the retrial of a white former police officer on murder charges in the fatal shooting of an unarmed black motorist during a 2015 traffic stop. Prosecutors said they would retry Tensing.

Tensing, who is white, shot DuBose, an unarmed black man, during a traffic stop on July 19, 2015.

The retrial judge has ruled that certain pieces of evidence presented in Tensing's first trial will not be admitted in the retrial.

"Ray Tensing, as he made that traffic stop, he didn't anticipate that Sam DuBose was going to drive off with Ray's arm caught in that auto", Stew Mathews told the jury during opening statements at a county courthouse in Cincinnati.

Mathews agreed that Tensing made a mistake by reaching into the auto.

Nine white jurors and three black jurors were seated Wednesday and were taken by a bus to the scene of the shooting.

Mathews said DuBose "wouldn't have ended up shot" if he had complied with Tensing's orders and hadn't attempted to flee.

There were six white men, four white women and two black women on that jury.
