Uber's Travis Kalanick punches back against the Benchmark lawsuit targeting him

Among Kalanick's statement of facts is a note that his mother had been killed in a boating accident when Benchmark was planning to oust him as CEO.

Travis Kalanick-a vocal fighter against taxi lobbyists, government regulations, pink mustache businesses, and tech giant Google-is speaking out again.

Firing back against an explosive lawsuit filed by one of Uber's most prominent investors, ex-CEO Travis Kalanick on Thursday night defended his right to remain on the ride-hailing company's board, and called the litigation a "personal attack" against him.

A few weeks later, Benchmark filed its lawsuit against Uber - a lawsuit Kalanick says defies common sense.

Kalanick also attacks the Benchmark investors for making moves to oust him while he was still mourning his mother's sudden death. The company said that it owns 13% of Uber and has 20% voting power on the board. Benchmark wants that 2016 decision rescinded, so pushing Kalanick from Uber's board. He further argued that the legal quarrel should take the arbitration route to resolution. Benchmark may try to convince other investors and board members to side with it, Gordon said, or the lawsuit might compel Kalanick back to the negotiating table.

Kalanick said that all of the allegations against him were already disclosed when he was granted the three seats. "Indeed, in the 14 months since the challenged amendments were signed, Benchmark never suggested that the amendments were "fraudulently induced" or in any way unenforceable, although all of the events on which it bases its claim of fraud were well known to Benchmark", the filing reads. "Its position was explicitly to the contrary". It has stunned the venture capital community and divided the Uber board.

Kalanick's filing gives a brief history of Uber, and a timeline of how Kalanick's July resignation came about.

Kalanick filed his response late on Thursday to the suit brought by Benchmark Capital, an early investor in Uber suing him for alleged fraud, breach of contract, and fiduciary duty.

Benchmark alleged information was withheld about the following: Pervasive gender discrimination and sexual harassment that prompted an investigation by former Attorney General Eric Holder; the alleged theft of medical records belonging to an Uber passenger who was raped in India; and self-driving auto startup Otto, which was acquired by Uber and is at the center of an ongoing lawsuit with Alphabet's Waymo.
