Woman sues Bill O'Reilly and Fox for defamation over sex harassment

"In fact, Mr. O'Reilly is the liar", according to the lawsuit, which was filed in federal district court in Manhattan.

Bernstein also alleged that O'Reilly violated the non-disparagement clause of their 2002 confidential settlement, and added that he and the network portrayed her and other accusers as "liar and politically motivated extortionist". Under a flood of sexual harassment allegations that he still denies despite several settlements and accusations, O'Reilly was pink slipped by FNC after over two decades on April 19 this year.

In a lawsuit filed Monday in U.S. District Court for the Southern District of New York, Bernstein said O'Reilly and Fox News broke their nondisclosure agreement in remarks to the New York Times. "Fox News took no action to protect plaintiff from O'Reilly". According to Bernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment. She's one of the five women named in an April New York Times report about $13 million worth of settlements by O'Reilly and the company. She accused him of forcing her into a "nonconsensual relationship".

She said Fox and O'Reilly misled the public by claiming that no one complained to a Fox hotline about his behavior.

A lawyer for Ms. Bernstein, Neil Mullin, asked that O'Reilly and Fox release all victims from their non-disclosure agreements in order to "let the truth out".

O'Reilly allegedly made other, similar comments since then. "It is cowardly to publicly attack these women knowing they have been subjected to contractual provisions requiring absolute silence".

Citing harm to Bernstein's reputation, "severe emotional distress, physical sickness, and loss of income", the complaint drills into the specific violations that it alleges both O'Reilly and FNC committed.

The defendants breached their agreement by making statements other than the agreed-upon statement that were false and defamatory, Bernstein alleges.

The suit also said that Fox News parent company 21st Century Fox falsely said in the story that there had never been any harassment complaints made against O'Reilly on a company hot line.

The story and others would cause O'Reilly to lose his job, but not before he commented, "Just like other prominent and controversial people, I'm vulnerable to lawsuits from individuals who want me to pay them to avoid negative publicity".
